Rechtssprechung zu Gebrauchtsoftware

Der Europäische Gerichtshof (EuGH) hat als oberstes rechtssprechendes Organ der europäischen Union mit seinem Urteil für endgültige Klarheit gesorgt und den Handel mit gebrauchten Computerprogrammen für grundsätzlich rechtmäßig erklärt.

Der EuGH entschied zudem, dass der Software-Gebrauchthandel auch dann zulässig ist, wenn es sich um online übertragene Software handelt.

Der BGH hat dann am 17.07.2013 hinsichtlich der zugrunde liegenden Rechtsfragen die Grundsatzentscheidung des EuGH vollumfänglich bestätigt. 

Und auch bei Volumenlizenzen und deren Aufsplittung ist das Urteil des EuGH anzuwenden. Dies bestätigte das Oberlandesgericht Frankfurt am Main in einem Verfahren zwischen Adobe und usedSoft.

In ihrer Urteilsbegründung stellten die 13 Richter der großen Kammer eindeutig fest, dass der Erschöpfungsgrundsatz bei jedem erstmaligen Verkauf einer Software gilt. Der EuGH verfügte sogar, dass der Zweiterwerber bei online  übertragenen Lizenzen die Software beim Hersteller erneut herunterladen darf: „Außerdem erstreckt sich die Erschöpfung des Verbreitungsrechts auf die Programmkopie in der vom Urheberrechtsinhaber verbesserten und aktualisierten Fassung“, so der EuGH. Der Gerichtshof ging damit deutlich über den Schlussantrag des EuGH-Generalanwalts vom 24. April 2012 hinaus.

VOLUMENLIZENZEN UND DEREN AUFSPLITTUNG EBENFALLS LEGAL

In einem späteren Urteil des Oberlandesgerichts Frankfurt am Main in einem Verfahren zwischen Adobe und usedSoft wurden die weiteren Konsequenzen des EuGH Urteils eindrucksvoll bestätigt: Das OLG Frankfurt entschied nämlich, dass das EuGH-Urteil auch bei Volumenlizenz-Verträgen und deren Aufsplittung anzuwenden ist. Eine Revision von Adobe wies der Bundesgerichtshof am 11.12.2014 vollumfänglich zurück (Az. I ZR 8/13). Damit wurde das Urteil des OLG Frankfurt letztinstanzlich bestätigt. 

Laut Microsoft Lizenzbestimmungen ist der Product Key zur einmaligen Aktivierung vorgesehen. Die Nutzungsdauer ist hierbei unbegrenzt, solange das Produkt auf dem gleichen Gerät genutzt wird. Sollte der Rechner neu formatiert werden, neu aufgesetzt werden oder es werden eventuelle Änderungen an der Hardware vorgenommen, so besteht keine Gewährleistung mehr, dass der Key weiterhin auf dem PC funktioniert.
